Privacy Policy

Welcome to www.buffaloworldjuniors.com (the “Site”), a website provided by Hockey Western New York, LLC, a New York limited liability company, (“WNY”) for the purpose of enabling you, either directly, or subject to Section 8, through links to other websites, to (1) obtain general information regarding the Buffalo World Juniors Hockey Championship to be held in Buffalo, New York from December 26, 2017 to January 5, 2018 (the “Tournament”) and other sporting events, (2) purchase tickets to the Tournament’s games and other sporting events, (3) purchase clothing and other merchandise relating to the Tournament, the International Ice Hockey Federation, the teams, sponsors and other organizations participating in the Tournament, or ice hockey and other sports, (4) reserve hotel rooms for the Tournament and for other purposes, and (5) apply for employment, which may or may not be related to the Tournament, offered by WNY or third-party employers. WNY recognizes the importance of protecting your privacy, and this policy covers WNY’s handling of information collected by it through the Site.

  1. Controller

    Any personal information collected by WNY through the Site is controlled by WNY in Buffalo, New York.

  2. Acceptance

    If you use the Site, your use of the Site is at all times subject to this policy, plus any other terms and conditions that may be posted on the Site (including, but not limited, any applicable terms of use). You should review this policy carefully, and be sure you understand it, prior to using the Site. Any use of the Site by you is deemed to be irrevocable acceptance of this policy. If you do not agree to this policy, you should not use, and should immediately exit, the Site. For purposes of this policy, accessing the Site only to review this policy or any applicable terms of use is not deemed to be use of the Site.

  3. Personal Information Collected

    WNY will collect information from you when you access and use the Site, and such information is covered by this policy. Conversely, third parties may also collect information from you pursuant to Section 8, and such information is not covered by this policy.

    All information provided by you to WNY through the Site must at all times be accurate and complete, and otherwise comply with the Site’s terms of use. If any such information changes, it is your responsibility to promptly notify WNY in writing of such change as set forth in Section 18. Such information may include, but is not limited to, the following:

    • Your name;
    • Your mailing address;
    • Your e-mail address;
    • Your phone number; and
    • Your credit card number, expiration date, verification code, card verification value or other similar security number, and billing address.

    WNY does not collect any personal information from you through the Site, unless it is provided voluntarily or automatically as set forth in this policy. If you provide your personal information to WNY through the Site, WNY will only retain such information to the extent appropriate to meet the purposes for which it was provided and for WNY’s other legitimate business purposes (including, but not limited to, marketing). If you refuse to provide any information when requested to do so by WNY or on the Site, you may not be able to access, or otherwise enjoy the benefits of, certain features of the Site.

  4. Protection of Personal Information

    WNY will use commercially reasonable efforts to protect your personal information from loss or unauthorized access, alteration, disclosure and use, except that certain information posted by you on the Site may, by its nature, be accessible to the general public, and WNY is not responsible for protecting such information from loss or unauthorized access, alteration, disclosure or use at any time. For example, if you participate in a public forum on the Site, any information disclosed by you when doing so will be available to the general public. Also, since no transmission of information over the Internet or electronic storage of information is completely secure, it is possible that your information could be lost or accessed, alteration, disclosed or used without authorization, even if WNY uses such commercially reasonable efforts. In providing information to WNY, you must assume the risk that unauthorized access or alteration to, and disclosure and use of, your personal information could occur.

  5. Use of Personal Information

    Any personal information collected by WNY through the Site may be used by it for any legitimate business purpose (including, but not limited to, marketing), unless expressly stated otherwise in this Section. Personal information that WNY expressly states in writing is collected for a specific purpose will only be retained and used for such purpose, unless you subsequently consent to its being used for another purpose. In the absence of a statement in writing by WNY that any personal information will be collected for a specific purpose, such information may be used for, among others, the following legitimate business purposes:

    • Correspond with you;
    • Process any orders for tickets or merchandise purchased by you through the Site; and
    • Provide you with promotional offers.

    When you provide personal information to WNY, whether or not for a specific purpose, WNY may disclose such information to third parties (including, but not limited to, subcontractors and vendors of WNY) that WNY has engaged to assist it in the ordinary course of its business for any purposes for which WNY could use such information. WNY will remain responsible for any such third party’s complying with all of WNY’s obligations pursuant to this policy in the case of any such disclosure.

    WNY may also at any time, in its sole discretion, disclose and use any personal information, whether or not you furnished such information for a specific purpose, to (a) comply with any applicable law or government request, (b) cooperate with law enforcement and other third parties in investigating a claim of fraud, illegal activity, or infringement of intellectual property rights, (c) protect the rights, property or legitimate interests of WNY or a third party, (d) transfer such information to a third party purchasing all, or substantially all, of WNY’s assets, or (e) transfer such information to USA Hockey and its affiliates for their fundraising and marketing purposes. WNY will have no responsibility for any action of a third party to whom or which such information is disclosed pursuant to the immediately preceding sentence.

  6. Analytical Information

    When you access the Site, WNY may, either directly or through third parties, collect from you through the use of “cookies” certain analytical information (including, but not limited to, (a) your search terms, pages reviewed by you, and items clicked on by you, and (b) your computer’s Internet protocol address, location, access date and time, connection speed, language, browser, operating system and manufacturer), none of which is personally identifiable, (collectively “Analytical Information”). Cookies are code placed on your computer by the Site that enable the Site to, among other things, (a) recognize your computer as a prior user of the Site, (b) provide the Site with details of your computer’s prior use of the Site and (c) otherwise assist WNY in making the Site more useful to you. WNY may use permanent cookies that are saved on your computer until you delete them, and session cookies that are automatically deleted when your browser is closed. Your browser may provide you with the ability to not accept cookies, as well as the ability to delete already-existing cookies. If you refuse, or delete previously-existing, cookies from the Site, you may not be able to enjoy some of the Site’s features.

  7. Use of Analytical Information

    In light of the nature of Analytical Information, WNY has no obligation to protect it from loss or unauthorized access, alteration, disclosure or use. Analytical Information may be used by WNY (a) to record your use of the Site, (b) to diagnose problems with the Site, (c) to improve the Site and make it more useful to users, (d) to determine patterns of usage of the Site by users, (d) to avoid the necessity of your having to reenter certain information previously provided through the Site, and (d) for other legitimate business purposes of WNY (including, but not limited to, marketing). However, Analytical Information will not be used by WNY to examine other websites visited by you before or after you use the Site.

    The Site may contain links to, or may be accessed by links from, websites provided by third parties (individually a “Third-Party Site”). Your use of any Third-Party Site will be subject to its privacy policies or practices, its terms of use and other applicable provisions, and you are solely responsible for complying with such policies, practices, terms and other applicable provisions. This policy does not cover the privacy policies or practices of any Third-Party Site, and WNY is not responsible for any information you submit to, or otherwise collected by, any Third-Party Site. WNY is only responsible for personal information it collects from you in connection with your authorized use of the Site.     You may from time to time send to WNY e-mail messages or other electronic communications in connection with your use of the Site or otherwise. If you do, WNY may collect and store your contact information and the contents of such messages or other communications. Your contact information and such contents will be used by WNY to respond to you and for other legitimate business purposes (including, but not limited to, marketing).

    WNY may from time to time, in its discretion, send you e-mail messages and other electronic communications using information provided by you, and in using the Site, you consent to WNY’s sending you e-mail messages and other electronic communications. E-mail messages and other electronic communications may be sent to you by WNY to respond to prior inquiries made by you, to inform you of products and services that are available from WNY or the Site and may be of interest to you, and for other legitimate business purposes (including, but not limited to, marketing). WNY endeavors to send e-mail messages and other electronic communications to only those individuals who desire to receive them. Instructions on how you can unsubscribe to WNY’s e-mail messages and other electronic communications are usually provided in such messages and other electronic communications. In addition, you can unsubscribe to such messages by contacting WNY as set forth in Section 18.

  10. Access

    Upon your written request, you will be granted access to your personal information collected and retained by WNY through the Site solely for the purpose of correcting or deleting any of such information that is inaccurate, except where the burden of providing such access would be disproportionate to the risks to your privacy or where the rights of a third party could be violated. You should contact WNY for this purpose as set forth in Section 18.

    Some jurisdictions do not allow the limitations or exclusions of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to User.

  11. Childen

    The Site is not intended for children under 13 years of age, and WNY does not intend to collect personal information from children under 13. However, if a parent or guardian of a child who is under 13 years of age discovers that the child’s personal information has been submitted to WNY through the Site without the parent’s or guardian's consent, WNY will use commercially reasonable efforts to remove such information from the Site and WNY’s servers at the parent’s or guardian's request. To request the removal of personal information of a child under 13 years of age, the parent or guardian must contact WNY as set forth in Section 18, and provide all information requested by WNY to assist it in identifying the information to be removed. Likewise, if WNY knows that any personal information of a child under 13 years of age has been received by WNY through the Site without the parent’s or guardian's consent, WNY will (a) use commercially reasonable efforts to remove such information from the Site and WNY’s servers or (b) obtain the consent of such child’s parent or guardian to retain such information.

  12. Applicable Law

    This policy will be governed by, and construed in accordance with, the laws of the state of New York, without regard to its principles of conflict of laws. To the extent there is any conflict or inconsistency between (a) any provision of this policy and (b) any provision of applicable law, the latter shall control.

  13. California Residents

    Pursuant to California law, residents of California may request certain information regarding WNY’s disclosure of personally-identifiable information to third parties for its direct marketing purposes. To make such as request, you must contact WNY as set forth in Section 18.

  14. Disputes

    If you have a dispute relating to this policy or WNY’s handling of your information collected through the Site, you must promptly notify WNY in writing of such dispute, and you and WNY must attempt, in good faith, to resolve such dispute. To the extent you and WNY cannot resolve such dispute after a reasonable period of not less than 30 days, and you desires to pursue other remedies, you (a) may, within one year after WNY receives your initial dispute notification, only commence a lawsuit against WNY in a court located in the county of Erie, New York, and having subject matter jurisdiction over such dispute, and (b) waive any right to object to such court’s being an improper venue, whether for inconvenience or otherwise, for such dispute. If you commence a lawsuit as set forth in this Section, you (a) waives any right to a jury trial, (b) consent to all findings of fact being determined by the presiding judge, and (c) waive any right to bring or join any claim against WNY as a member or other participant in any class action or other similar form of litigation.

  15. Entire Agreement

    This policy contains the entire agreement, and supersedes all prior oral and written proposals, understandings and agreements, between you and WNY, with respect to information collected by WNY through the Site. No provision of this policy can be amended, and no right or remedy arising under this policy can be waived, except (a) in a writing signed by you and WNY and (b) as set forth in Section 17.

  16. Severability

    Whenever possible, each provision of this policy shall be interpreted to be effective and valid under applicable law. If, however, any such provision shall be prohibited by or invalid under such law, it shall be deemed modified to conform to the minimum requirements of such law, or if for any reason it is not so modified, it shall be prohibited or invalid only to the extent of such prohibition or invalidity without the remainder of such provision, or any other provision of this policy, being prohibited or invalid.

  17. Revisions

    WNY may revise any provision of this policy from time to time by posting the revised provision on the Site, with the revised provision taking effect immediately upon such posting. It is your responsibility to periodically check this policy on the Site for revisions. Your use of the Site following the posting of any revision to this policy on the Site will be deemed an irrevocable acceptance by you of such revision.
